Allegations Against 3M Company

3M Company is said to have knowingly manufactured and sold millions of dollars’ worth of defective Dual-Ended Combat Arms™ Earplugs to the U.S. Defense Logistics Agency between 2003 to 2015. Following that deceptive act, thousands of deployed military personnel who served in Iraq and Afghanistan during this 12 year timeframe were issued these ineffective earplugs as part of their standard gear.

The United States Department of Justice (DOJ) conducted an independent investigation to determine validity of these allegations. Based on investigation findings, the DOJ determined 3M did know about the following design defects that could result in permanent hearing loss and/or tinnitus:

Earplugs were designed too short and did not fit well in a wearers ears.
Earplugs would loosen making it impossible for them to effectively mitigate excessive noise as they were claimed to do.

False Claims Act Whistleblower Lawsuit

Resulting from the recent whistleblower lawsuit, United States ex rel. Moldex-Metric v. 3M Company, Case No. 3:16-cv-1533-MBS (D.S.C.), 3M agreed to pay $9.1 million to settle allegations of knowingly selling defective earplugs to the U.S. military. The lawsuit was filed under the qui tam, or whistleblower, provisions of the False Claims Act.

What is noteworthy about the lawsuit is that it doesn’t settle allegations of wrongdoing; 3M never admitted any liability or guilt. Furthermore, none of the nine million dollar settlement amount will be given to military personnel who may have suffered permanent hearing loss. Consequently, the outcome of the lawsuit is why Lerner and Rowe now evaluates individual hearing impairment lawsuit claims linked to 3M Dual-Ended Military Earplugs.

The San Francisco Bay area, gateway to the Pacific, has long played an important role in the trade of Asian art treasures. At Michaans’s Auctions, high quality Asian art and antiques have been a core business since the company’s inception. In the March Gallery Auction, Michaan’s offers precious Chinese snuff bottles, a delightful bronze elephant, and Japanese woodblock prints by Hiroshige. Also among the March highlights is the large collection of engravings by Karl Bodmer, whose body of work forms an important historical record of the American West. Bodmer’s exquisite 19th century scenes of Native Americans will thrill collectors of fine art as well as American history buffs. Estate jewelry, period furniture and many more fabulous finds are also offered at Michaan’s on March 9.
A good snuff bottle collection is a survey of Chinese art, in miniature. The insidepainted snuff bottles ($400-$600 for the lot of three in the March auction) feature the delicate brushstrokes of traditional Chinese painting in an art form that never fails to fascinate. The pair of overlay glass snuff bottles ($600-$800) features the carved glass technique perfected by Chinese artisans after centuries of carving jade. And the glazed snuff bottle ($300-$400) is robin’s egg blue, a favored hue among collectors of Chinese porcelain.

Is there any animal more universally beloved than the elephant? Revered by many cultures and cherished by even more, the elephant is an important motif in the decorative arts and interior design. March brings to Michaan’s a handcrafted bronze Asian elephant estimated at $1,000-$1,500, with polychrome decoration and a lovely patina.
The works of master printmaker Hiroshige (1797-1858) are fundamental to any collection of Japanese woodblock prints. Hiroshige’s reputation was already well established in his day, and later in the 19th century his works were discovered and even copied by the European Impressionists including Van Gogh. A collection of eleven Hiroshige woodblock prints ($1,800-$2,000) is featured in the March auction. Scroll paintings, embroidered textiles, carved jade and fine Chinese porcelains are also offered.
The art of Karl Bodmer (1809-1893) is presented in March by Fine Art specialist Susan Paffrath, who offers ten lots of Bodmer’s hand-colored engravings. “The value of Bodmer’s work is recognized by historians as well as art collectors,” notes Paffrath. “His wonderful images document the great diversity in Native American cultures, while also highlighting the individuality of his particular subjects.” Bodmer’s engraving of a dancing warrior (“Pehriska-Ruhpa”) is estimated at $5,000-$7,000, one of many Indian portraits on offer. Also offered are the wildlife scene, “Herd of Bison and Elks” ($2,000-$3,000) and a view of 19th century Niagara Falls ($1,000-$2,000).
“Milestone Mountain” ($3,000-$5,000), an Ansel Adams print with excellent provenance, is another fine art highlight. Works by Peter Max and Roy Lichtenstein are offered. “Summer,” a bronze by cowboy artist William Moyers (1916-2010) is estimated at $2,000-$4,000. The large oil painting “Jungle” by Fernand Pierre is one of two works by Haitian artists. Pierre’s lush pictorial style recalls that of the 19th century French painter Henri Rousseau, while springing wholly from the natural environment and artistic heritage of his native Haiti.
Brilliant color and lushness can also be found in Michaan’s March fine jewelry. A stunning floral enameled jewelry suite features diamonds, ruby cabochons and cultured pearls set in 22k gold. The large Mughal-style suite by a contemporary Indian designer is estimated at $30,000-$50,000. Also offered is a beautiful jadeite jade bangle bracelet ($4,000-$6,000). “The bangle comes with a GIA report confirming ‘A’ jade, no color treatments, and has wonderful translucency” says Michaan’s gemologist Elise Coronado.

A standout in March is the custom diamond ring designed as a comet, with a trail of diamonds following from the brilliant-cut center stone of over one carat ($2,000-$3,000). The sapphire ombré bead necklace ($1,800-$2,500) is another highlight. A gleaming 18k gold bracelet, heavy with gold coins and charms, is estimated at $4,000-$6,000. 25 of the March jewelry lots come from the estate of Wylda Hammond Nelson, MD, who collected beads and tribal jewelry from around the world. These lots include the ancient Persian necklace ($500-$700) of etched carnelian and carnelian beads.
Estate furniture highlights include the McGuire bamboo form dining table and eight chairs, a great find at $1,000-$1,500. Luxury items in this auction include a Fendi fur and a Daum pitcher.

Gray's Wednesday, March 13th auction in Cleveland will boast nearly 300 lots of fine art, furniture and decorative arts

This untitled oil on board painting by the Czech painter, graphic artist and illustrator artist Zdeněk Sklenář (1910-1986) is a candidate for top lot of the auction (est. $20,000-$40,000).

Painted terracotta sculpture titled Head of a Woman by Edris Eckhardt (1905-1998), an American artist associated with the Cleveland School, 19 inches tall (est. $3,000-$5,000).

Oil on canvas titled Still Life with Flowers after Margaretha Haverman (circa 1693-after 1739), the renowned flower painter from the Northern Netherlands (est. $5,000-$7,000).

Watercolor by the American Modernist painter William Sommer (1867-1949), titled Landscape with Houses, signed lower right (est. $3,000-$5,000).

Two large paintings by Thompson Lehnert (American, b. 1931), will include this one titled Freedom, signed lower right and measuring 52 ¼ inches by 45 inches (est. $2,000-$3,000).

The sale will be highlighted by artwork from noted Czech collector Jaroslav Mervart. It will be held at 10 am Eastern time, online and live in Gray’s gallery.

CLEVELAND, OHIO, UNITED STATES, February 22, 2019 /EINPresswire.com/ — A mid-week auction featuring nearly 300 lots of fine art, furniture and decorative arts from fine estates across the country – highlighted by artwork from the noted Czech collector Jaroslav Mervart – will be held Wednesday, March 13th, at 10 am Eastern time by Gray’s Auctioneers, online and live in Gray’s gallery at 10717 Detroit Avenue in Cleveland.

The full catalog is up and pre-bidding is open at GraysAuctioneers.com. Bidding is also available on Liveauctioneers.com and Invaluable.com. Phone and absentee bids will also be accepted. In-person previews will be held Thursday thru Wednesday, March 7th thru 13th, from 10-5; and Saturday, March 10th, from noon-4 pm. All previews will be held in Gray’s gallery. All times quoted here are Eastern.

With a pre-sale estimate of $20,000-$40,000, an untitled oil on board painting by the Czech painter, graphic artist and illustrator artist Zdeněk Sklenář (1910-1986) is a candidate for top lot of the auction. The painting, from the Jaroslav Mervart collection, measures 26 inches by 20 inches and is signed and dated (“’46”) lower left. It was previously exhibited at the Roudnice Art Gallery, near Prague, in 1982.

An oil on canvas titled Still Life with Flowers after Margaretha Haverman (circa 1693-after 1739), the renowned flower painter from the Northern Netherlands, should realize $5,000-$7,000. The original of the vibrant painting is housed at the Metropolitan Museum of Art in New York. The one in the auction, unsigned and measuring 40 inches by 30 inches, was relined twice, heavily repainted and revarnished.

A painted terracotta sculpture titled Head of a Woman by Edris Eckhardt (1905-1998), an American artist associated with the Cleveland School, carries an estimate of $3,000-$5,000. The 19-inch-tall sculpture is mounted to a base with three brass screws and plaster, possibly by the artist. The piece has been signed at the base. Ms. Eckhardt is best known for her work in ceramic art and glass sculptures.

Also posting a pre-sale estimate of $3,000-$5,000 is a watercolor by the American Modernist painter William Sommer (1867-1949), titled Landscape with Houses. The work, signed lower right, is housed in a frame measuring 17 ¼ inches by 19 ½ inches. In 1911 Sommer co-founded the Kokoon Arts Club, to promote modern art in Cleveland. Paintings by him currently reside in the Cleveland Museum of Art.

Two large paintings by Thompson Lehnert (American, b. 1931), an artist widely known for works that often portray figurative bodies but also works in abstraction, are expected to attract bidder attention. An oil on canvas titled Freedom is signed lower right and measures 52 ¼ inches by 45 inches. The other is an untitled acrylic on canvas, also signed and 40 inches by 53 inches. Both should bring $2,000-$3,000.

A selection of drawings by Emil Orlik (1870-1932), the Czech-born painter, etcher and lithographer, will come up for bid. The son of a tailor, Orlik lived and worked in Prague, Austria and Germany. He studied at the Munich Academy, later learned engraving and experimented with various printmaking processes, visited Japan to learn woodcut techniques and taught at the Berlin College of Arts & Crafts.

Orlik’s drawings in the sale include a charcoal on wove paper signed, dated and titled London 1898 lower right (est. $300-$500); and three lots of multiples, to include two pencil on wove paper figural studies, one signed and dated; two pencil and conte figural studies (plus a third study by an unknown artist); and three unsigned figural studies: two pencil on paper, one ink on paper (all est. $200-$400).

Rounding out a few more of the sale’s expected top lots will be several early 16th century woodcuts and engravings, to include a pair of woodcuts on laid paper (with watermarks) by Albrecht Dürer (German, 1471-1528), titled The Birth of Mary (circa 1503, sheet 5 of the series The Life of Mary), and The Last Supper from the Large Passion (1510). Each is monogrammed and expected to sell for $1,000-$2,000.

From the same category is an engraving on laid paper by the Dutch artist Lucas van Leyden (1494-1533), titled The Praising of Lazarus (circa 1508), having a one-handle jug with a quatrefoil finial watermark. The 11 ½ inch by 8 inch work, with pencil notations and an ink collector’s stamp on verso, is estimated to bring $800-$1,200. Van Leyden was a painter and printmaker in engraving and woodcut.

Reliable end user feedback from all continents

In our annual security survey we received responses from 88 countries coming from all continents around the globe. The survey was conducted from December 14th, 2018 to December 24th, 2018.

Some highlights are:

AV-Comparatives determined, that majority of users (86%) were well protected in the last 6 months, having not suffered a malware infection in this period. A little over a third (35%) stated that their security product had blocked malware within the last week, indicating how easy it is to encounter a threat. So AV-Tests are very important, to inform about the quality of the products.

The number of users who rely on free desktop security software has risen again this year, standing at 44% of users. There has been a drop in the number of users without antivirus software, which is now down to 0.5%.
Over three quarters of this year’s respondents have moved to Windows 10, leaving Windows 7 with under a fifth of users.
A little under a half of respondents (45%) use a Virtual Private Network (VPN). In Iran, UAE, Iraq and China, at least three quarters of users deploy a VPN.

Google Chrome is the most popular browser, with getting on for half of respondents (45.6%) using it. Mozilla Firefox accounts for a lot of the remaining users, with a share approaching a third (29.2%). Despite being built into the increasingly popular Windows 10, and being Microsoft’s recommended browser on this OS, Microsoft Edge is only used by one in 20 of users overall.
